description La presente investigación lleva por nombre: “La responsabilidad civil del empleador durante el periodo de prueba”, el objetivo general de nuestra investigación fue: Determinar si es procedente indemnizar por daños y perjuicios que le ocasione al trabajador la resolución unilateral de la relación laboral durante el periodo de prueba, el diseño de investigación que se utilizo es el explicativo, la población y muestra es cualitativa, en base a pronunciamientos jurisprudenciales sobre el tema propuesto, teniendo como técnica e instrumento de recolección de datos: el análisis documental y el registro de análisis de documentos, arribando a la conclusión que: La casación laboral N° 7095-2014-LIMA, es un avance de nuestra jurisprudencia que frente a casos concretos inclusive aun durante el periodo de prueba si existe afectación al proyecto laboral el trabajador cuando exista un ejercicio abusivo del derecho por parte del empleador, el trabajador puede acudir al poder judicial y demandar la indemnización por los daños que le hubiesen sido irrogados.
