description En el presente trabajo de investigación tiene por finalidad incorporar el abandono asistencial como causal de indignidad, debido a que en el art. 667 del código civil se señalan causales que no garantizan la debida protección del adulto mayor, es así que como objetivo general se planteó ¿Como el abandono asistencia influye en la causal de indignidad?, es así que se planteó como objetivo: Determinar como el abandono asistencial influye en la causal de indignidad. Se utilizó un enfoque cualitativo, un tipo de estudio básico con el diseño de teoría fundamentada. Es así que se concluyó que debe incorporarse al abandono asistencial como una causal de indignidad debido a que es una constante en nuestra cultura, las personas mayores sufren una discriminación especial y esto ocurre porque las normas no le brindan la protección necesaria, permitiendo que a pesar de que son abandonados por sus familias, estos pueden gozar de los bienes dejados en vida. Es así que se recomienda que deben crearse instituciones especializadas y destinadas a dar seguimiento a la situación familiar de las personas adultas, darles atención legal y psicológica para evitar que sufran de estos maltratos.
