description La presente investigación titulada: “AFECTACIÓN DEL DERECHO AL TRABAJO DERIVADA DE LA APLICACIÓN DEL ART. 398-B EN CONCORDANCIA CON EL ART. 398-A DEL CÓDIGO PENAL PERUANO”, tiene como objetivo identificar las causas y efectos de cohecho específico, su modificación y aplicación en el ámbito de la función policial. Es de estudio cualitativo ya que hace que el análisis del método sea interpretativo participativo, por ello, se utilizó las encuestas, entrevistas, así como documentos, dirigidas a Fiscales y Abogados, como también utilizando el instrumento de cuestionario de choferes con ayuda de la guía documental. Obteniendo resultados de nuestros instrumentos y concluyendo con nuestra investigación, podemos decir que, suspender o inhabilitar de forma definitiva la licencia de conducir del conductor de vehículos motorizados, afecta de manera directa el derecho al trabajo de los conductores, ya que impide el normal desarrollo de la actividad laboral a la que se dedicaron por años, frustrando así el normal desarrollo de su vida y afectando gravemente su economía.

It is a qualitative study since it makes the analysis of the method participatory interpretative, therefore, surveys, interviews, as well as documents, addressed to Prosecutors and Lawyers, as well as using the questionnaire instrument of drivers and officers with the help of the documentary guide.
