description En el Perú, los internamientos involuntarios se han regulado en la reciente Ley de Salud Mental de 2019. En el presente texto, se buscará analizar los cambios legislativos que dieron origen a la actual regulación de la privación de libertad relacionada con una situación de salud mental. De manera paralela, se buscará mostrar cómo la regulación ha dejado fuera ciertos supuestos que permiten la existencia de abusos en la práctica del internamiento involuntario. Finalmente, se buscará analizar cómo los operadores jurídicos, en especial el Tribunal Constitucional, ha utilizado (o ignorado) la actual normativa en la materia.
