Sumario:This research seeks to determine the need to incorporate the subdivisions of the term “plagiarism” in the doctrine in view of the growing music industry, and the impact that it would generate if it were included in copyright law. Therefore, we will analyze the doctrine related to the specificity of the term, the relationship to be generated, if included, with copyright law and the influence of the originality criterion. Likewise, it will allow us to identify the presence or absence of a single definition of “originality” in copyright law and thus determine the difference or the limit between such concept and the “inspiration” in the process of creation of a musical work. Based on the analysis and comparison of casuistry of the United States, a country with the most developed music industry in the world, in plagiarism lawsuits and its resolutions, the current context in Peru on the matter and the tools that are available for this purpose. Among the conclusions, it is proposed that the presence and proposal of different types of plagiarism generates a greater uncertainty in the determination of the cases to be sanctioned, as well as a negative impact on a unified criterion in the jurisprudence and law on originality in a musical work.
