Through a comparative analysis, the study explores the impact of ideology, legal culture, and conservative social movements on judicial decision-making in both cases. The study concludes that these determinants, acting interdependently, function as causal mechanisms in judicial decision-making, explaining shifts in positions and arguments in both Chile and Peru. Additionally, the study highlights that the judicialization of emergency contraceptive methods has had both positive and negative impacts on women’s reproductive rights.Este estudio examina la judicialización de los derechos reproductivos en Perú y Chile, centrándose en la influencia de factores extrajurídicos sobre las decisiones judiciales relativas a la distribución del Anticonceptivo Oral de Emergencia (AOE) durante los períodos 2006-2009 y 2007-2008, respectivamente. Mediante un análisis comparativo, se explora el impacto de la ideología, la cultura jurídica y los movimientos sociales conservadores en la toma de decisiones judiciales en ambos casos. El estudio concluye que estos determinantes, de manera interdependiente, operan como mecanismo causal en el decision-making judicial, explicando el cambio de postura y argumentos, tanto en Chile como en Perú, respectivamente.
