The discussion analyzes the limits of current legal tools –such as copyright, antitrust, and agency authority– while questioning whether traditional regulatory justifications remain valid in the digital era. The text also reflects on the ideological and political drivers behind current regulatory trends and raises the challenge of measuring Big Tech power beyond market metrics.Este artículo explora las tensiones entre la innovación y el poder de los gobiernos en la regulación de la inteligencia artificial y las Big Tech. Mientras Europa adopta marcos regulatorios proactivos como la Ley de Mercados Digitales, aprovechando su tradición jurídica sofisticada, Estados Unidos mantiene un enfoque reactivo, basado en principios generales y litigios antimonopolio. China, por su parte, representa un modelo distinto de gobernanza centralizada. El texto analiza los límites de herramientas jurídicas tradicionales –como el derecho de autor, el derecho de la competencia y la actuación de las agencias– y cuestiona si sus justificaciones siguen siendo válidas en la era digital.
