description The administration of justice by the Judicial Branch begins with the Magistrates' Courts, which constitute the first level within the hierarchical organization of this branch of government. They are followed, in ascending order, by the Specialized Courts, Superior Chambers and Supreme Chambers, which assume a series of competencies assigned to them by the national legal system. In this article we will address the competence by subject matter of the Labor Magistrates Courts, with emphasis on the expansion of their competencies, reviewing the changes produced in the 02 Labor Procedural Laws of Peru and the introduction of competencies made by the IX Supreme Labor Plenary of the year 2022. Although the Law is an important normative instrument in national law, nowadays jurisprudence has gained great importance within the sources of law, assuming a creative role, thus overcoming the traditional role of mere applicator and interpreter of the Law. This is the case of the jurisprudence of the Supreme Court of the Republic and the Constitutional Court, which have contributed to the legal development of the country with a wide margin of legitimacy when they establish criteria nurtured with a high content of justice that society expects. In the case of the competence of the labor courts of peace, in this article we notice an absence of concern on the part of the Legislative Power in facing the problem presented; assumed in part by the Supreme Court of the Republic through a Supreme Labor Plenary. We will see if the legal solution given is complete or if it requires additional measures.

We will see if the legal solution given is complete or if it requires additional measures.Después de 80 años de su creación y casi 20 años desde la Enmienda Constitucional que estableció los contornos de su competencia, los Tribunales del Trabajo se enfrentan a un conflicto jurisprudencial sin precedentes con el Tribunal Supremo y su inclinación a equilibrar la protección tradicional del régimen laboral con la autonomía de la voluntad de las partes y la libre iniciativa de la nueva dinámica económica. El presente estudio pretende analizar el entendimiento que ha esbozado el Supremo Tribunal Federal sobre la validez de las diferentes formas de contratación permitidas por el ordenamiento jurídico del Brasil y si los tribunales laborales tienen competencia para conocer de los conflictos derivados de estos contratos, tal y como establece el artículo 114, I, de la Constitución de 1988, modificado por la CE n.º 45/2004. Aunque el Supremo Tribunal Federal y los Tribunales Regionales de Trabajo estén de acuerdo en que la forma del contrato no subsiste si los hechos revelan que el trabajo se realizó de forma subordinada, el Tribunal Constitucional y los Tribunales de Trabajo siguen discrepando sobre la validez a priori de regímenes jurídicos alternativos al contrato de trabajo, como en los ejemplos de las profesiones reguladas y de los conductores de aplicaciones de transporte, como se desprende de las diversas decisiones recientes dictadas por el Supremo Tribunal en el juicio de Reclamaciones Constitucionales.Passados 80 anos da sua criação e quase 20 anos da Emenda Constitucional que fixou os contornos da sua jurisdição, a Justiça do Trabalho está diante de um conflito jurisprudencial inédito com o Supremo Tribunal Federal e a sua inclinação de equilibrar a tradicional proteção do regime trabalhista com a autonomia de vontade das partes e a livre inciativa das novas dinâmicas econômicas. O presente estudo busca analisar o entendimento que vem sendo traçado pelo Supremo Tribunal Federal acerca da validade das diferentes formas de contratação permitidas pelo ordenamento jurídico brasileiro e se a Justiça do Trabalho possui competência para o julgamento das ações decorrentes desses contratos, na forma como estabelecida pelo art. 114, I, da Constituição de 1988, com redação dada pela EC n.º 45/2004.
