Así, aunque la figura del Suma Alzada pueda parecer fácil de entender y aplicar, con cada vez más frecuencia se advierten controversias durante la ejecución contractual en las cuales, el Contratista solicita ampliaciones de plazo, costos directos, mayores gastos, entre otros, pues surgen situaciones no contempladas en la oferta. Tal problemática, a nuestro punto de vista, tiene su génesis en la limitada e inexacta información que la Entidad entrega a los postores, situación que lleva a estos últimos a ofertar un monto equivocado, que no refleja la realidad de los trabajos a realizarse. En ese orden de ideas, el presente trabajo plantea la problemática en torno al sistema de Suma Alzada cuando la información entregada resulta insuficiente, así como presentar los problemas contractuales que comúnmente surgen de esta.

This represents a non-variable price defined based on the quantities, magnitudes, and/or qualities previously indicated by the contracting entity. Thus, although the Lump Sum system may appear straightforward to understand and apply, increasingly frequent disputes arise during the execution of the contract. In these cases, the contractor requests extensions of time, direct costs, additional expenses, among others, due to unforeseen circumstances not contemplated in the original offer. In our view, this issue stems from the limited and inaccurate information provided by the contracting entity to the bidders, which leads them to submit an incorrect proposal that does not reflect the actual scope of work to be performed.
