description El presente Trabajo de Investigación tiene por objetivo principal determinar la afectación de derechos fundamentales como la igualdad, no discriminación, libertad, educación e intimidad de las y los postulantes que participan de los procesos de admisión llevado a cabo por la Escuela Nacional de Formación Profesional Policial –Escuela de Oficiales y Escuelas de Educación Superior Técnico Profesional Policial-; por cuanto, en la primera etapa de dicho proceso, se exige la presentación de una declaración jurada de “Estar soltero(a) y no tener hijos”, conforme lo establece el artículo 70-A del Decreto Supremo N° 021-2019-IN, que modifica el Reglamento del Decreto Legislativo N° 1318, Decreto Legislativo que regula la formación profesional de la Policía Nacional del Perú, aprobado por Decreto Supremo N° 022-2017- IN; Máxime, cuando previo a la dación del Decreto Legislativo N° 1318, Decreto Legislativo que regula la formación profesional de la Policía Nacional del Perú, su Reglamento aprobado por Decreto Supremo N° 022-2017- IN y modificatorias efectuadas mediante Decreto Supremo N° 002-2019-IN y Decreto Supremo N° 002-2019-IN respectivamente, el Tribunal Constitucional ha prohibido considerar como desventaja la condición de padre o madre, o de encontrarse en la condición civil de casado(a); y, la institución policial es la encargado de respetar y hacer respetar las normas constituciones y sobre todo proscribir todo tipo de vulneraciones.
