Es por ello que, en el presente Informe se analizará si es que la inminente clausura del Centro vulneraría el derecho a la alimentación adecuada de los beneficiarios. Para este análisis, se debe determinar si el derecho a la alimentación, en tanto DESCA, es judiciable en el ordenamiento jurídico peruano; y, si es que el servicio de alimentación brindado por el Centro correspondería a obligación mínima esencial del Estado, la cual si es que no se cumpliría vulneraría el derecho a la alimentación. Para poder realizar este análisis se empleará instrumentos normativos tanto internacionales como del derecho interno peruano. Respecto a los primeros, serán de utilidad la DUDH, el PIDESC, la CADH, el PSS, y la jurisprudencia de la CorteIDH. Por su parte, en la norma interna se utilizará la Constitución y el Código Procesal Constitucional. De la presente investigación se puede concluir que, el cierre del referido Centro constituiría una vulneración al derecho de alimentación adecuada, por cuanto los beneficiarios no podrían disponer ni acceder a alimentos que les permita tener una vida digna. Asimismo, el Estado estaría incumpliendo su obligación de efectivizar progresivamente de los DESCA.

However, due to the end of the concession, this Center will close. For this reason, in this paper will analyze if the imminent closure of the Center would violate the right to food of the beneficiaries. For this analysis, it must be determined if the right to adequate food, as an ESCER, is justiciable in the peruvian legal system; and if the food service provided by the Center corresponds to a minimum core obligation of the peruvian State, if it is not fulfilled, the State would violate the right to adequate food. For this analysis, will be used international normative instruments and Peruvian domestic law. It will be used the UDHR, the ICESCR, the ACHR, the PSS, and the jurisprudence of the Inter-American Court. In the internal regulation will use the Constitution and the Constitutional Procedural Code. From the present investigation it can be concluded that the closure of the aforementioned Center would constitute a violation of the right to adequate food, since the beneficiaries could not have or access to food that allows them to have a dignified life.
