La Sección 2 identifica el impacto social y ambiental de la minería informal/ilegal y los títulos administrativos como instrumentos básicos para la regularización. Se analizan programas y estrategias ejecutadas, entre las que se incluyen la descripción de los requisitos a cumplir. En la Sección 3 se estudia la aplicación del derecho administrativo en la formalización de la minería informal: se detectan problemas como la falta de recursos, la corrupción o la burocracia en la instancia regional; la ausencia de coordinación entre las autoridades competentes. Por lo cual, se sugieren estrategias de fortalecimiento de la regulación y formulación de mejores trámites para asegurar que la aplicación del derecho administrativo en el sector sea más eficaz, indicando como alternativa la estipulación de un límite temporal.

Section 1 highlights the constitutional and legal framework for mining, highlighting the need for rules that separate and correctly regulate the different types of mining, as well as the weaknesses that hinder the correct management of mining deposits. Section 2 identifies the social and environmental impact of informal/illegal mining and administrative titles as basic instruments for regularization. Programs and strategies implemented in Peru are analyzed, including a description of the requirements to be met. Section 3 studies the application of administrative law in the formalization of informal mining: problems such as lack of resources, corruption or bureaucracy in the regions, lack of coordination between competent authorities are detected.
