Lima: GRADE.Este capítulo busca demostrar que la delimitación de áreas con restricción a la actividad minera impulsada desde el aparato estatal peruano no siempre goza de la legitimidad social y efectividad institucional necesaria para garantizar la exclusión de la minería en áreas de alto valor económico, cultural o socioecosistémico. En contraste, las zonas de exclusión establecidas por movimientos sociales con alta visibilidad mediática, o legitimidad local o regional, pueden llegar a ser más efectivas en la práctica para estos propósitos. Asimismo, propone que la generación de una institucionalidad y la articulación de un sistema normativo en materia de exclusión o restricción de la actividad minera en el Perú tiene que dejar de lado la óptica binaria y minerocéntrica actual. Debería, en cambio, anidarse dentro de una política de ordenamiento territorial más amplia y participativa, con un enfoque multisectorial y descentralizado. Así, esta política debe partir de una iniciativa de cambio social desde abajo, lo que significa centrarse en la activa participación de las comunidades y poblaciones locales como motor de transformación socioinstitucional.This chapter seeks to demonstrate that the delimitation of areas with mining restrictions promoted by the Peruvian state apparatus does not always enjoy the social legitimacy and institutional effectiveness necessary to guarantee the exclusion of mining in areas of high economic, cultural or socio-ecosystemic value. In contrast, exclusion zones established by social movements with high media visibility, or local or regional legitimacy, may be more effective in practice for these purposes. It also proposes that the generation of an institutional framework and the articulation of a regulatory system for the exclusion or restriction of mining activity in Peru must leave aside the current binary and minerocentric perspective. Instead, it should be nested within a broader and more participatory land-use planning policy, with a multi-sectoral and decentralized approach.
