Based on the sanction imposed on the president of Osiptel, evaluated by the Civil Service Tribunal, the practical utility of determining facts and indeterminate legal concepts in the disciplinary sphere is analyzed. To this end, discretion and the mechanisms available for its control are examined, with the aim of reducing the risks of arbitrariness and abuse of power. It is emphasized that its application can be carried out both in administrative and contentious-administrative settings. Each of these mechanisms is then examined in depth, with special emphasis on those that are the subject of analysis. The tribunal's decision is then addressed, identifying both the reasons for the invalidity of the investigating authority and the inconsistencies of the tribunal itself. Using hermeneutical, sociological, and historical techniques, it is concluded that it is essential for the authority to fully identify the facts using these tools for controlling discretion.
