Despite the efforts of the State and the continuous extensions to Law No. 27651 and the Integrated Mining Formalization Registry (REINFO), no effective structural reforms have been implemented to improve this situation. Thus, under an ex post evaluation of the law and an economic analysis of the law, the effectiveness of state incentives for the design and implementation of the formalization process is examined. It is concluded that it is essential to enact laws that, instead of focusing solely on economic development, prioritize legal and political assessments to combat illegal mining and protect the environment.La presente investigación aborda el desafío de la formalización minera en el Perú, destacando la ineficacia del proceso actual evidenciada por la baja tasa de formalización, que apenas alcanza el 2.22%. A pesar de los esfuerzos del Estado y las continuas prórrogas a la Ley N.°27651 y el Registro Integrado de Formalización Minera (REINFO), no se han implementado reformas estructurales efectivas que mejoren esta situación. De este modo, bajo una evaluación ex post de la norma y de un análisis económico del Derecho, se examina la efectividad de los incentivos estatales para el diseño e implementación del proceso de formalización.
