This research addresses the challenge of mining formalization in Peru, highlighting the ineffectiveness of the current process as evidenced by the low formalization rate, which barely reaches 2.22%. Despite the efforts of the State and the continuous extensions to Law No. 27651 and the Integrated Mining Formalization Registry (REINFO), no effective structural reforms have been implemented to improve this situation. Thus, under an ex post evaluation of the law and an economic analysis of the law, the effectiveness of state incentives for the design and implementation of the formalization process is examined. It is concluded that it is essential to enact laws that, instead of focusing solely on economic development, prioritize legal and political assessments to combat illegal mining and protect the environment.
