Sumario:The main objective of the text is to analyze what has been the position of the Supreme Court of Justice of the Nation in Mexico regarding the right to privacy of public servants in social networks versus the right of access to public information that individuals have. This will allow to identify whether there is a clash between these rights and, if so, to determine which is the rule for the solution that the highest court of the country established to resolve the case. To carry out the above, two concepts pointed out by Aharon Barak were used, the factual assumption and the clause of application of fundamental rights, which will allow knowing if there are limits to any of the rights in question from the analysis of Amparo a Revision 1005/2018, in order to comply with the objective of this work. Finally, some ideas are presented by way of conclusion.
