Descripción
Sumario:This paper presents research on the use of the doctrine of jurist Aharon Barak and its influence on the rulings of the Federal Judiciary in Mexico. To this end, a comparative method was used to determine the influence of doctrinal formants. In this regard, the rulings of the Supreme Court of Justice of the Nation and the Electoral Tribunal of the Federal Judiciary were analyzed to measure the use of his work and determine which topics are addressed in the author's extensive bibliography in order to find the areas where the Federal Judiciary has used his legal theory to find possible theoretical frameworks for resolving judicial problems. It was concluded that, at least in the last seven years, the most widely used works were: i) Proportionality. Constitutional Rights and their Limitations (English and Spanish versions); and ii) A judge reflects on his work: The role of a constitutional court in a democracy. These texts have essentially served to justify the role of the judge and proportionality in human rights matters.
