In the face of a conflict, citizens can follow different ways to solve it. But, how justice is configurated in the conclusion of a specific conflict? what guarantee that the procedure of the mechanism is fair? We can think here in the due process of law; nevertheless, due process of law does not reach all mechanisms of conflict resolution.This paper, therefore, focuses in the study of the role of justice in (i) the procedural scope of judicial process and ADR mechanisms; and in (ii) the conflict resolution generated by them.

The paper explores the foundations of procedural law, highlighting its relevance as a fundamental legal science for the social order. It begins with a critique of the doctrinal underdevelopment of procedural law in Peru, pointing out that procedural law has historically been considered secondary. He then presents several key concepts: traditional procedural law, which conceives it as a set of adjective rules subordinated to substantive law; modern procedural law, which frames it in a dialectical sphere with substantive law; and, finally, the post-publicist vision, which orients it towards social justice, understood as a fundamental right. The article begins by recognizing that the Administrative Process in Peru is full jurisdiction, protects the legal situations in addition to control the legality of the administrative acts. Since the growing health crisis produced by COVID-19, our economic, social, and judicial environment has undergone several changes. Among these changes are the measures adopted by the judiciary to continue protecting rights and to continue with «normality» in its own work. This article comments on Directive No. 007-2020-CE-PJ approved by Administrative Resolution of the Executive Council of the Judiciary No. 000167-2020-CE-PJ, which implemented the «Simplified and Virtual Process of Food for Children and Adolescents». Indeed, it will be analyzed its main scopes and relevant modifications with regards to the traditional process. Likewise, the experience of the Superior Court of Justice of La Libertad with respect to the implementation of the virtual form of food demand will be taken into consideration.

This article presents the virtues and results of the order for payment process applied in other latitudes to show that it is a process that, far from the discussion of its legal nature, manages to resolve conflicts submitted to this in a reasonable time. Then, the minor labor processes that are processed under Law No. 29497 are analyzed. It is concluded that these processes can be adapted or submitted to the order for payment process, which would allow their processing and resolution to be carried out within a reasonable time, thus achieving the speed proclaimed by the new labor procedural law.

Para ello, se utilizará como base de análisis la Sentencia del Tribunal Constitucional recaída en el expediente N° 03891-2011-PA/TC. Este trabajo analiza la decisión en mayoría adoptada por el Tribunal Constitucional en el marco de la sentencia recaída en el expediente N.º 03549-2021-AA/TC. Es un proceso constitucional de amparo en la que se analiza si hubo vulneración del derecho a la tutela procesal efectiva, el debido proceso y, en especial, el derecho a la debida motivación de las decisiones. El Banco Central de Reserva del Perú afirma que la casación 14107-2017 Lima, del 1 de diciembre de 2017 debe ser declarada nula por contravenir los derechos antes mencionados. Al respecto, el Tribunal Constitucional señala que no hubo vulneración de ningún derecho, muchos menos del derecho a la debida motivación, puesto que la sentencia fue correctamente motivada. This work describes and evaluates the application of a module to increase the specific abilities set in action when students resolve math problems. Such abilities are: analyzing the problem, identifying and laying out strategies, applying algorithms and revising the process that leads to the solution. The module presents problems solved by the teacher (modelling strategies) and uses the work of peers in order to consolidate and evaluate the work. The study uses a quasi experimental design with two pre defined groups, pre and post test. The sample was not probabilistic and was formed by 70 students. A test with 10 math problems was used as the instrument meant for the students to use the four strategies suggested in the module. Results show a difference in favor of the experimental group, which allows us to conclude that the module has an influence in the evaluated abilities.

The existence of early and timely resolution processes for matters of simple processing is now a reality. With the introduction of orality in judicial processes, the great challenge lies in obtaining true justice as a quality public service. What simple processes are solved in a differentiated way is not a problem, but a solution.
