El Instituto Nacional de Defensa de la Competencia y de la Protección de la Propiedad Intelectual (Indecopi), en cooperación con la Conferencia de las Naciones Unidas sobre el Comercio y Desarrollo – UNCTAD, organizó los talleres denominados "Aplicación del Protocolo de Nagoya sobre acceso a los recursos genéticos y la participación justa y equitativa de los beneficios: Aspectos de Propiedad Intelectual".

At the 2024 WIPO Diplomatic Conference, after 25 years of negotiations between megadiverse countries and users of genetic resources, the “Treaty on Intellectual Property, Genetic Resources, and Traditional Knowledge Associated with Genetic Resources” was approved. Its goal is to improve the quality of the patent system in these areas and prevent erroneous grants. To achieve this, it establishes two mechanisms: the “Disclosure Requirement” and “Information Systems.” The first was widely debated, while the second requires support for patent offices and Indigenous peoples. This study analyzes its implications, implementation, and relationship with agreements such as the Nagoya Protocol and TRIPS.

The Peruvian production of cocoa represents, approximately, 2% of the world production, with a very recognized contribution because of the quality and diversity of its flavors and aromas. With a millenary Amazonian origin and proved utilization by at least 5200 years ago, this crop just became visible for the agrarian development in the last two decades, when it was used with relative success for the substitution of illegal coca crops ¿And how much is the academy contributing to the value chain of cocoa? A sample of 44 theses which cocoa obtained from production centers and farmers plots was their object of study, has been registered and analyzed in an exploratory way. 41 theses were for obtain professional titles, two for magister degree and one for doctorate degree. Perú es un país mega diverso, en el habita un gigantesco número de animales, plantas y culturas propias. Su riqueza biológica se debe a la variedad de regiones naturales que conforman diferentes paisajes en el territorio peruano. Ante tal situación el Estado peruano enfrenta una lucha por proteger sus recursos biológicos de la biopiratería, pues aquella viene generando serios perjuicios para el Perú, y en especial a las comunidades campesinas y nativas que han visto cómo se apropian de sus conocimientos tradicionales. The Convention on Biological Diversity is an international legal instrument aimed at undertaking global efforts for the conservation and sustainable use of biological diversity components and sharing the benefits of using genetic resources. This article takes stock of the achievements and challenges of this global agreement and proposes new strategic objectives and crucial goals post-2020 to reverse the accelerated loss of species and collapse of ecosystems. This paper reviews in detail the strategies adopted by the Convention on Biological Diversity in two strategic plans from 1993 to 2020, and the thematic programs and the Cartagena and Nagoya protocols.
