description El presente trabajo de investigación tiene por finalidad determinar la naturaleza jurídica del daño ambiental, para este cometido es imperante establecer el alcance del término “ambiente” como bien jurídico protegido y la caracterización del daño ambiental como antesala a comprender el fenómeno jurídico objeto de estudio, a través del método deductivo y alcance descriptivo se pretende reparar la demanda manifiesta por la doctrina nacional e internacional sobre la incertidumbre jurídica que se despliega del daño ambiental, la escasa jurisprudencia sobre la materia, la ausencia cognitiva por parte de los operadores jurídicos sobre su carácter bifronte; el daño ambiental puro y el daño ambiental por influjo. Mediante la revisión sistemática de doctrina especializada nacional e internacional y demás fuentes del derecho, se plantea a modo de hipótesis, la naturaleza jurídica no patrimonial del daño por sus características; difuso, significativo, e intergeneracional.
