description RESUMEN El presente informe tiene por objeto principal en desarrollar un análisis doctrinario y legal del proceso signado con el número 1363-2010 tramitado ante el Tercer Juzgado Civil Especializado de la Corte Superior de Justicia de Cajamarca, sobre Proceso Constitucional de Amparo. Para lo cual, en un primer momento se establecerá el marco teórico que servirá de base para emitir las reflexiones en torno a la pretensión, para posteriormente realizar un examen procesal de las actuaciones jurisdiccionales, incidiendo en los defectos de forma y fondo incurridos por el Magistrado al momento de desarrollar el iter procesal así realizar un análisis exhaustivo de cada una de las sentencias que forman parte de cada instancia. Con lo cual se busca poner en práctica los conocimientos asimilados durante el estudio de la carrera de Derecho y materializarlos en críticas objetivas, respecto de la actuación de nuestros órganos jurisdiccionales, y poner en evidencia las debilidades de nuestro sistema de Justicia. PALABRAS CLAVE: Acción de Amparo, Derecho al Trabajo, Relación Labora, Proceso Constitucional de Amparo, Motivación de Sentencias.ABSTRACT The main purpose of this report is to develop a doctrinal and legal analysis of the process signed with the number 1363-2010 processed before the Third Specialized Civil Court of the Superior Court of Justice of Cajamarca, on the Constitutional Process of Amparo. For which, at first the theoretical framework that will serve as the basis for issuing the reflections on the claim will be established, to subsequently conduct a procedural review of the jurisdictional proceedings, focusing on the defects of form and substance incurred by the Magistrate at the moment of developing the procedural iter so perform a thorough analysis of each of the sentences that are part of each instance. With this, we seek to put into practice the assimilated knowledge during the study of the career of Law and materialize it in objective criticism, regarding the performance of our jurisdictional bodies, and highlight the weaknesses of our Justice system.
