description El propósito de la presente investigación se enfoca en analizar respecto a si el proceso de filiación extramatrimonial vulnera o no el derecho constitucional del debido proceso, toda vez que su constitucionalidad recae en la disposición contemplada en el inc. 3 del artículo 139° de la Constitución, además de todas las garantías procesales a desarrollar en nombre de la tutela jurisdiccional efectiva. De la misma manera, frente a la discusión doctrinaria sobre si el derecho de defensa, al ser uno de los derechos procesales dentro del marco del debido proceso, resulta vulnerado o no en el proceso de filiación extramatrimonial. En tal sentido, el presente trabajo pretende analizar la acumulación de pretensiones y la calidad de cosa juzgada, siendo evaluados ambos en el proceso judicial de filiación extramatrimonial.

En tal sentido, el presente trabajo pretende analizar la acumulación de pretensiones y la calidad de cosa juzgada, siendo evaluados ambos en el proceso judicial de filiación extramatrimonial.The purpose of the present investigation is focused on analyzing whether or not the extramarital filiation process violates the constitutional right of due process, since its constitutionality is based on the provision contemplated in article 139, paragraph 3 of the Constitution, in addition to all the procedural guarantees to be developed in the name of effective jurisdictional protection. Likewise, in the face of the doctrinal discussion on whether or not the right of defense, being one of the procedural rights within the framework of due process, is violated in the process of extramarital filiation.
