description En el presente trabajo tenemos como objetivo la determinación de factores que favorecen la trata de personas con fines de explotación laboral en el Perú en los últimos 5 años. Esta investigación tiene un enfoque cualitativo y como muestra cuenta con diez especialistas en derecho penal y laboral, así como análisis documental de dos expedientes. Como instrumento, se utilizó una guía de entrevista dirigida a los abogados y guía de análisis documental. Teniendo como resultados la identificación de las causas que contribuyen a este delito, así como la vulneración de diversos derechos fundamentales. En conclusión, la falta de educación, falta de oportunidad laboral, el estado de necesidad, entre otros factores, contribuye a que la trata de personas con fines de explotación laboral aun perdure. Recomiendo al Estado otorgar la logística necesaria a las autoridades competentes de fiscalización, con la debida capacitación para que puedan desarrollar un trabajo eficaz para prevenir este delito.

This research adopts a qualitative approach and involves a sample of ten specialists in criminal and labor law, as well as documentary analysis of two case files. The instrument used includes a guided interview aimed at lawyers and documentary analysis. The results lead to the identification of causes contributing to this crime, as well as the violation of various fundamental rights. In conclusion, factors such as lack of education, lack of job opportunities, and economic necessity, among others, contribute to the persistence of human trafficking for labor exploitation.
