description RESUMEN La libertad política es uno de los valores primordiales de la democracia. En ese sentido, dicho valor debe ser enaltecido y protegido dentro de todas las sociedades democráticas. El Perú es un Estado constituido democráticamente, sin embargo, no asegura plenamente la libertad política al establecer en su Norma Fundamental que el derecho al voto es obligatorio para los ciudadanos menores de setenta años. Con la implantación de esa obligación, se distorsiona la naturaleza jurídica del voto, el cual es un derecho, y por ser así, su ejercicio debe existir con total libertad. Considerando ello, se concluye que la Constitución Política del Perú de 1993, al instaurar el voto obligatorio, transgrede irrebatiblemente la libertad política de sus ciudadanos, y a la vez, perjudica severamente a la democracia.

In that sense, this value should be exalted and protected in all democratic societies.
