La demandante acreditó su propiedad con una escritura pública de 1994 debidamente inscrita en Sunarp, mientras que la demandada sostuvo que el bien fue adquirido con fondos familiares y que su posesión era legítima. Pese a estos argumentos, la justicia peruana priorizó el título de propiedad inscrito frente a la falta de pruebas de un derecho real o contractual que justificara la permanencia de la hermana en el predio. El proceso transitó por todas las instancias bajo la vía sumarísima, resultando en sentencias favorables para la demandante tanto en primera como en segunda instancia. Ante la persistencia de la demandada, esta interpuso un recurso de casación; sin embargo, fue declarado improcedente por la Sala Superior debido al principio de doble conformidad.
