spelling Vilchez Cabeza, Piero Giordano2023-10-27T14:58:06Z2023-10-27T14:58:06Z2023https://hdl.handle.net/20.500.12727/12726Modalidad de obtención de grado y/o título sin designación de asesorEn el presente informe jurídico se analiza la investigación, juicio y condena que se le realiza al ciudadano A.R.V.R. por la presunta comisión del delito de violación sexual de menor de edad regulado en el segundo párrafo del artículo 173 concordado con el numeral 2 del referido artículo del Código Penal -modificado por el artículo 1 de la Ley N° 30076, publicado el 19 de agosto del año 2012-, en agravio de la menor de iniciales E.Y.L.C.A., y tramitado bajo las reglas del Código de Procedimientos Penales. Luego de realizada la actividad de investigación, la Décimo Cuarta Fiscalía Provincial Penal de Lima emite la formalización de la denuncia penal con lo cual el caso de judicializa y pasa a cargo del juez instructor perteneciente al Décimo Cuarto Juzgado Penal de Lima; sin embargo, debido a que el imputado es internado en un establecimiento penitenciario como consecuencia de la imposición de la medida coercitiva de carácter personal de prisión preventiva, el caso se deriva al Trigésimo Primer Juzgado Penal para Procesos con Reos en Cárcel de Lima, quien finalmente concluye la instrucción y eleva los autos a la Segunda Sala Penal para Procesos con Reos en Cárcel de Lima, la cual realiza el control de acusación -producto de la acusación fiscal- y luego emite el auto de enjuiciamiento con lo cual el caso pasa a etapa de juzgamiento a cargo de la Fiscalía Superior Penal de la Séptima Fiscalía Provincial Corporativa de Cercado de Lima – Breña y Jesús María como ente acusador y la Segunda Sala Penal para Procesos con Reos en Cárcel de Lima como ente juzgador. Después del desarrollo del juicio, la Sala resuelve condenando a A.R.V.R., imponiéndole la pena privativa de libertad de cadena perpetua, así como a la reparación civil de veinte mil nuevos soles; asimismo, dispuso que el sentenciado sea sometido a tratamiento terapéutico, a fin de facilitar su readaptación social.
