Posteriormente, se dirigió a la casa de su vecino para solicitarle que le prestara su celular con el fin de comunicarse por messenger con el imputado. En dicha conversación, la menor agraviada acordó verse con el imputado; circunstancia por la que ambos terminaron en un lugar oscuro cerca al cementerio ubicado en la calle Santa Rosa; siendo que, a las 23:30 horas aproximadamente, el imputado empezó a besarla, a tocarla las partes del cuerpo, luego le bajó el short y su ropa interior hasta las rodillas, poniéndose en su encima y penetrándola. Es así que, la menor le indicó que sentía dolor y trató de apartarlo. En respuesta, el imputado le prometió que le regalaría un celular a cambio. Ahora bien, en fecha 02 de agosto del 2019, la madre de la menor agraviada se apersonó a la fiscalía a denunciar los hechos; lo que motivó la intervención y posterior detención del imputado. Por lo tanto, el Juzgado a cargo condenó al acusado como autor del delito en cuestión, aplicándose la sanción regulada en el artículo 173° del Código Penal. Por lo que, se le impuso diez años de pena privativa de libertad efectiva; asimismo, ordenó el pago de S/ 1,000.00 por reparación civil a suma.
