Después de la revisión y análisis del Atestado Policial y las diligencias llevadas a cabo, el Primer Juzgado Penal del Módulo Básico de Justicia de San Juan de Lurigancho formalizó denuncia contra J.M.A.S, en calidad de autor. La Séptima Fiscalía Superior Penal de Lima formuló acusación contra el imputado, solicitando se le imponga treinta y dos años (32) de pena privativa de libertad. Después del desarrollo del juicio, la Primera Sala Penal para Proceso con Reos en cárcel condenó al imputado imponiéndose treinta (30) años de pena privativa de libertad. Sentencia que fue impugnada por la defensa del imputado vía Recurso de Nulidad.
