Repositorio Académico USMPhttps://hdl.handle.net/20.500.12727/19298Modalidad de obtención de grado y/o título sin designación de asesorEl presente informe jurídico analiza el contenido del Expediente Penal N.º 02136-2022, seguido contra el sentenciado con iniciales E.J.R.V, por la comisión del delito de TOCAMIENTOS INDEBIDOS, ACTOS DE CONNOTACIÓN SEXUAL O ACTOS LIBIDINOSOS EN AGRAVIO DE MENORES DE EDAD; en este caso, en agravio de la menor con iniciales CH.P.N.S. Según la documentación obrante en autos, la denuncia fue interpuesta por la madre de la menor luego de que su hija le contara que, el 01 de marzo de 2022, a las 12:00 horas, en circunstancias de que se encontraba haciendo limpieza, su tío, la alzó en brazos, la llevó hasta su cama, le besó todo su cuerpo, la desvistió, se desvistió, le mordió el labio superior de la boca y le frotó su pene sobre sus piernas y su vagina. Razón suficiente para que el Representante del Ministerio Público del Distrito Judicial de Lambayeque, formalice investigación preparatoria para luego formular su Requerimiento Acusatorio contra E.J.R.V, solicitándole 14 años de pena privativa de la libertad; y, la suma de S/ 2, 000.00 soles como concepto de Reparación Civil. En primera instancia, el Juzgado Penal Colegiado, emitió sentencia condenatoria, imponiéndole a E.J.R.V, 14 años de pena privativa de la libertad, así como el pago de S/ 2, 000.00 soles, como concepto de Reparación Civil; misma que fue impugnada por el condenado; sin embargo, dicha apelación fue desestimada por la Segunda Sala Penal de Apelaciones, en mérito a que confirmó la Sentencia de primera instancia, de fecha 20 de setiembre de 2022, en todos los extremos.
