description El estudio titulado «Criterios jurisprudenciales para la indemnización al padre legal por el daño moral ocasionado por la atribución de paternidad biológica falsa» se enfoca en determinar los criterios objetivos que los jueces deben considerar al indemnizar el daño moral sufrido por el padre legal debido a una atribución de paternidad biológica falsa. Aunque el daño moral no tiene una naturaleza económica, el juez debe analizar cada caso para establecer si existe un daño moral y determinar una compensación proporcional. El objetivo principal de la investigación es contribuir a la defensa de los derechos fundamentales, como la dignidad, la verdad biológica y el derecho a la identidad tanto del menor como del padre legal. Después de un estudio detallado, se concluye que se debe indemnizar al padre legal por el daño moral en casos de falsa atribución de paternidad biológica, siempre y cuando se cumplan ciertos supuestos, como la actuación dolosa o culposa por parte de la madre al imputar la paternidad, la separación de los cónyuges desde que se conoció el hecho y el cuidado del menor bajo la custodia del padre legal.

The main objective of the research is to contribute to the defense of fundamental rights, such as dignity, biological truth and the right to identity of both the minor and the legal father.
