description La presente investigación tuvo por objetivo principal describir de qué manera se regula la Responsabilidad Penal dentro del marco de la Ley N°30407. El Método de la presente investigación presenta un diseño no experimental – transversal con enfoque cualitativo por su naturaleza jurídica, en el modelo jurídico descriptivo. El instrumento a utilizar es la entrevista estructurada en la que se realizarán preguntas relacionadas a la Responsabilidad Penal que se enmarca dentro del Tipo Penal regulado en Ley 30407, utilizando los formularios de Microsoft Office Forms Online debido al contexto de Pandemia COVID-19. Se ha obtenido como Conclusión Principal: Se ha determinado que la forma en la que se expresa la responsabilidad penal dentro del marco de la Ley 30407 se da manera muy ambigua, a pesar de la incorporación del artículo 206-A, teniendo aún este aparente delito quedado en el olvido y no estando aplicándose de manera práctica en la realidad de los hechos suscitados.
