description Como problema general de la presente se formuló la siguiente: ¿La prueba de oficio regulada en el Código Procesal Penal de 2004 afecta la imparcialidad del juez penal?, siendo su objetivo: determinar si la prueba de oficio regulada en el Código Procesal Penal de 2004 afecta la imparcialidad del juez penal. Asimismo, el supuesto general de la presente fue que: La prueba de oficio regulada en el Código Procesal Penal de 2004 no afecta la imparcialidad del juez penal. Los métodos generales que se utilizaron fueron: análisis y síntesis. El método específico fue el método explicativo, el tipo de investigación es una investigación jurídica – dogmático, siendo el nivel de investigación el de carácter descriptivo. Como conclusión principal se señala que: se logró determinar que la prueba de oficio regulada en el Código Procesal Penal de 2004 no afecta la imparcialidad del juez penal, porque esta sólo es ejercida por el juez penal de forma excepcional.
