description La presente investigación, de enfoque básica y descriptiva, tiene como propósito determinar por qué el Ministerio Público no viene solicitando medidas cautelares para futura ejecución forzada en la etapa de investigación preparatoria con la finalidad de asegurar el pago de la futura reparación civil que se ordenará en la sentencia, para ello se ha empleado los métodos deductivo, inductivo y sintético. Asimismo, se ha empleado la técnica de la entrevista a especialistas de Derecho Penal de la región Amazonas, entre ellos a fiscales adjuntos superiores, fiscales provinciales y fiscales adjuntos provinciales del Distrito Fiscal de Amazonas, a quienes se les ha realizado preguntas de opinión y desarrollo respecto a la problemática y variables de la presente investigación, instrumentos mediante los cuales se ha podido contrastar y validar la hipótesis consistente en que el Ministerio Público no viene solicitando medidas cautelares para futura ejecución forzada en la etapa de investigación preparatoria debido a la falta de una norma imperativa en el Código Procesal Penal que le exija al Fiscal solicitar medidas cautelares; y, en atención a ello, se plantea una propuesta legislativa, como la incorporación y modificación de algunas normas del Código Procesal Penal, referidas a las medidas cautelares para futura ejecución forzada, como son el embargo y secuestro conservativo
