description El propósito de la investigación fue determinar si con la emisión de una ley que regule la maternidad subrogada en el ordenamiento jurídico civil se llegaría a proteger los derechos de la gestante colaboradora, en una gestación con técnicas de reproducción asistida. Para resolver este enunciado se acudió a la técnica del análisis documental consistente en la revisión de la doctrina y legislación comparada para identificar su desarrollo y postura respecto a la aplicación de la técnica de reproducción asistida de maternidad subrogada y sus distintas modalidades. Asimismo, se utilizó la encuesta como instrumento a partir de un cuestionario a jueces especializados en familia, así como profesionales en la salud como obstetras y ginecólogos quienes opinaron en cuanto a la necesidad de regular la maternidad subrogada para proteger los derechos de la madre gestante. Siendo que esta investigación es necesaria para postular una regulación que proteja los derechos de la gestante colaboradora como el derecho a la dignidad, otorgarle asistencia médica integrar a su salud física y psíquica, antes, durante y después del embarazo, con la intención de proteger su vida y salud introduciendo dentro del ordenamiento jurídico la figura de maternidad subrogada a través de la modificación del artículo 7 de la Ley General de Salud y el artículo 361 del Código Civil (filiación); modificatorias que se incorporan como recomendación y proyecto de ley de modificación.

To resolve this statement, he resorted to the documentary analysis technique consisting of the review of the doctrine and comparative legislation to identify its development and position regarding the application of the assisted reproduction technique of surrogate motherhood and its different modalities. Likewise, the survey was used as an instrument based on a questionnaire to judges specialized in family matters, as well as health professionals such as obstetricians and gynecologists who gave their opinion regarding the need to regulate surrogate motherhood to protect the rights of the surrogate mother.
