La investigación suplementaria es una institución nueva que surgió con la puesta en vigencia del Código Procesal Penal en el Perú. Conforme a la regulación contenida en la norma procesal, el juez puede ordenar ante un pedido fiscal de sobreseimiento y previa oposición actos adicionales de investigación que hayan sido pedidos por el oponente, siempre que considere no procedente el pedido fiscal. Esa investigación adicional no tiene un plazo de duración expresamente señalada en la ley, en relación a ello es que se ha elaborado este trabajo de investigación con el siguiente título: “REGULACIÓN EXPRESA DEL PLAZO DE LA INVESTIGACIÓN SUPLEMENTARIA EN EL CÓDIGO PROCESAL PENAL PERUANO” A raíz de este título lo que se ha señalado se llegó a corroborar la hipótesis de que debe existir un plazo legal señalado para la duración de la investigación suplementaria, a fin de desnaturalizar este plazo y además de vulnerar el plazo razonable que como criterio debe ser siempre tenido en cuenta, para ello se hizo de los diversos métodos como el hermenéutico para desentrañar de las disposiciones la esencia de esta figura, el método comparativo para evaluar lo que sucede en otras realidades y además el método sistemático arribar a las conclusiones que se han plasmado. Se propuso una solución a partir de los argumentos señalados en el análisis de los resultados, con el firme convencimiento que ello permitirá un mejor uso de esta figura y con ello, una mejora en la administración de justicia del país. |
