description La presente tesis titulada “La tipicidad de la tenencia de arma con licencia vencida en la nueva redacción del tipo penal de tenencia ilegal de arma” pretende determinar si la tenencia de arma con licencia vencida constituye delito de tenencia. Para ello se determinó si existe conflicto entre el nuevo tipo penal del delito de tenencia ilegal de arma y la Casación N° 211-2014, determinar cuáles son los elementos materiales del delito de tenencia ilegal de arma como delito de mera actividad y de peligro abstracto y analizar si la tenencia de arma con licencia vencida constituye desvalor del acto y desvalor del resultado del delito de tenencia ilegal de arma. Para ello se usó el método inductivo, analítico y sintético. Se concluyó que el hecho materia de análisis si constituye delito de tenencia ilegal, toda vez que se crea un peligro abstracto pues la falta de renovación no permite corroborar que el portador cuente con las capacidades físicas, psíquicas, legales, y con la habilidad necesaria para hacer un uso adecuado del arma.

To do this, it was determined if there is a conflict between the new criminal type of the crime of illegal possession of a weapon and Cassation No. 211-2014, determining what are the material elements of the crime of illegal possession of weapon as a crime of mere activity and abstract danger and analyze whether possession of a weapon with an expired license constitutes disrepute of the act and disvalue of the result of the crime of illegal possession of a weapon. For this, the inductive, analytical and synthetic method was used.
