description EL presente trabajo tiene por objetivo hacer de conocimiento a la comunidad jurídica en general, sobre la transgresión al derecho de la imparcialidad que tiene toda persona a la cual se le pretende investigar por el delito de receptación aduanera, a la que previamente el ente recaudador a través de Aduanas, le ha incautado bienes prohibidos o adquiridos de manera ilegal., en ese sentido se estableció como enunciado del problema principal el siguiente: ¿Cuándo se afecta el principio de imparcialidad en las investigaciones penales por el delito de receptación aduanera en el Perú?; asimismo se formuló como objetivo general del presente trabajo de investigación el siguiente: Determinar cuándo se afecta el principio de imparcialidad en las investigaciones penales por el delito de receptación aduanera en el Perú, posterior a ello se estableció la hipótesis de la siguiente manera: El principio de imparcialidad en las investigaciones penales por el delito de receptación aduanera en el Perú, se afecta cuando la administración aduanera que es parte agraviada del proceso emite el informe pericial oficial sobre el valor de las mercancías para que sea consideradas como delito de receptación aduanera, en ese sentido se hizo uso de los métodos jurídicos, luego se pudo contrastar la hipótesis con los resultados de manera contundente, esto se ve reflejado en las conclusiones del presente trabajo de investigación
