description En el presente proyecto se analizó la falta de regulación jurídica de la maternidad subrogada en la legislación peruana, considerando la necesidad de un marco legal para proteger los derechos de quienes participan en los procedimientos de reproducción asistida. La ausencia de una normativa específica deja desprotegido el proceso de gestación subrogada, planteando la importancia de criterios que priorizaran la voluntad procreacional y resguardaran los derechos humanos. La investigación, de carácter cualitativo y descriptivo, abordó los aspectos éticos, teóricos y legales de este tipo de práctica, y culminó en una propuesta de Proyecto de Ley, con el objetivo de permitir el acceso seguro a la maternidad subrogada, brindando respaldo legal a quienes lo necesitaran.
