description Introducción: La presente investigación se titula: Protección restitutiva del amparo y las aristas habilitadas al juez para reparar el daño, jurisprudencia del Tribunal Constitucional, Lima – 2022, considerando como Problema General: ¿De qué manera la protección restitutiva del proceso de amparo le habilita al juez distintas aristas para reparar el daño causado, Lima - 2022? Metodología: Se plantea una investigación de forma aplicada, nivel explicativo, enfoque cualitativo y diseño no experimental – transeccional. Asimismo, se consideró como población de estudio a 72 Abogados Colegiados y Habilitados del Ilustre Colegio de Abogados de Lima. Conclusión: El proceso de amparo que brinda protección restitutiva habilita al juez el uso de distintas aristas a fin de reparar el daño patrimonial o extrapatrimonial que se ha causado. En efecto, esta herramienta judicial no solo busca restablecer los derechos fundamentales afectados, sino que también permite al juez considerar y abordar las diferentes dimensiones del perjuicio sufrido por el demandante. Recomendación: Se recomienda que se modifique el Código Procesal Constitucional (Ley Nº 31307), a fin de que permita al Aquo tamizar los procesos que ameritan admitirlos siempre que se haya afectado derechos constitucionales.
