En cuanto a la muestra se tiene 50 abogados en ejercicio, conocedores del manejo de los procesos de agravio constitucional de la ciudad de Lima aplicando una encuesta anónima y cuestionario de preguntas cerradas. Resultado: No es suficiente el marco protector de la intimidad personal previstos en los artículos 2°. 5-6 y 7 y 200°.3 de la Constitución Política peruana, lo reconoció el 56% del sondeo de la muestra. Son bienes jurídicos fundamentales, vulnerables que requerían mayor protección en el marco del nuevo Código Procesal Constitucional Ley 31307. El 78% reconoció que hay desconocimiento en la población respecto a la acción de garantía constitucional de habeas data. Concluyendo: Frente al acopio y procesamiento de información ilegal con fines de negocio debe interponerse el habeas data como protección de derechos constitucionales de la persona humana
