description The present thesis " The Congenital Incompatible Malformations with The Life like grounds of the Therapeutic Abortion and the Implementation of a National Protocol that regulates the Mechanisms for the legal interruption of the pregnancy in Peru " it takes as aims the Incorporation of the congenital incompatible malformations with the life as additional grounds of the therapeutic abortion, since this would allow to safeguard, in a positive way, the effective exercise of the human rights of the woman, since they are: the right to life, right to liberty, right to enjoy the benefits of scientific progress, right to privacy, the right not to be subjected to cruel, inhuman and degrading treatment, the right to health and medical care, the right to personal security, the right to equality, the right to non-discrimination, right to information and the right to freedom of religion and conscience. And implement a National Level Protocol mechanisms governing health care on Therapeutic Abortion, in order to ensure a Safe and Legal Abortion. medical and legal arguments to justify the inclusion of congenital anomalies incompatible with life within the therapeutic abortion, to analyze and clarify the human rights are violated and to identify arguments that help support the implementation of a National Protocol on Therapeutic Abortion, which ensures, as already mentioned a safe and legal abortion in line with practices Health and Human Rights. It proposes to incorporate as a new causal therapeutic abortion: congenital malformations incompatible with life, in this sense is suggested amending Article 119 of the Criminal Code of Peru

It proposes to incorporate as a new causal therapeutic abortion: congenital malformations incompatible with life, in this sense is suggested amending Article 119 of the Criminal Code of PeruLa presente tesis «Las Malformaciones Congénitas Incompatibles con La Vida como causal del Aborto Terapéutico y la Implementación de un Protocolo Nacional que regule los Mecanismos para la interrupción legal del embarazo en el Perú» tiene como objetivos la Inclusión de las malformaciones congénitas incompatibles con la vida como causal adicional del aborto terapéutico, ya que esto permitiría salvaguardar, de manera positiva, el ejercicio efectivo de los derechos humanos de la mujer, como son: el derecho a la vida, derecho a la libertad, derecho a gozar por los beneficios del progreso científico, derecho a la privacidad, derecho a no ser sometido a trato cruel, inhumano y degradante, el derecho a la salud y a la atención médica, el derecho a la seguridad personal, el derecho a la igualdad, el derecho a la no discriminación, derecho a la información, y al derecho a la libertad religiosa y de conciencia. Así como implementar un Protocolo a Nivel Nacional que regule los mecanismos de atención médica sobre el Aborto Terapéutico, a fin de que se garantice un Aborto Seguro y Legal. El trabajo de investigación se orienta a explicar el por qué las malformaciones congénitas incompatibles con la vida no deben ser consideradas como un tipo de aborto eugenésico; así como, identificar argumentos médicos y jurídicos que justifiquen la inclusión de las malformaciones congénitas incompatibles con la vida dentro del aborto terapéutico; analizar y precisar los derechos humanos que se ven vulnerados; e identificar argumentos que contribuyen a sustentar la implementación de un Protocolo Nacional sobre Aborto Terapéutico, que garantice, como ya se mencionó un aborto seguro y legal, acorde con las prácticas sanitarias y los Derechos Humanos.
