Our goal is to propose a solution in order to avoid conflicts between two institutions: The peasant rounds recognized by law and the constitution and the judiciary, a state agency responsible for the administration of ordinary justice. Throughout our investigation we have established that the conflict of competences is generated because there is no legislation that delimits the competition of peasant rounds. Although the judiciary is seriously questioned because of the little procedural speed, as well as the lack of transparency in the administration of justice, it is also true that the peasant rounds in their eagerness to administer justice in the scope of their jurisdiction create discomfort to the judges who try to ignore customary law and customs and customs of the peasant rounds. More abundantly, the rounds resolve conflicts in different aspects, civil, criminal, family, etc. In many cases they exceed and generate problems with the same members of their community, resulting in frequent cases reported by kidnapping, coercion, usurpation of functions, etc. In this context, the present investigation consists in describing and explaining the formative process, the mechanisms and procedures used in the resolution of conflicts, the rural development activities promoted by the peasant rounds of Chota, within the framework of respect for human rights and organizational development; actions that in many cases generate controversy because the integrity of the investigated person is not guaranteed, that is, in the inquiries within the hovering organization a due process is not respected, the procedures and inquiries are consistent with their uses and customs, it is more Our Magna Carta guarantees the due process, with the presumption of innocence, the pro-probation and the defense of the accused, rights that are not exercised within the organization hovering. With the healthy purpose of taking legal gaps and compromising a close relationship between peasant rounds and the judiciary, I propose a rule that delimits both territorial competence and subject matter competence for peasant rounds, at the same time a rights education program is suggested human and organizational development for the peasant rounds to improve the performance of ronderil in the resolution of conflicts, in coordination with the judiciary and with respect to due process, in order to avoid criminal proceedings for usurpation and other crimes attributed to the ronderos. Knowing the efficiency in the administration of justice of the peasant rounds, within the scope of their jurisdiction I propose at the same time, the modification of the criminal procedural code in relation to the preliminary investigation, in whose inquiries the hobbyists should participate and be considered as evidence the acts and clarifications that they make in the rural communities are valid. It is good to note that in order to formalize this work, the investigator has used interviews with the ronderos, interviews with judges, prosecutors and other law operators working in chota-Cajamarca.

No obstante, las Rondas tienen jurisdicción especial otorgada por la ley, diariamente se suscitan problemas, incluso enfrentamientos entre las rondas campesinas, el Poder Judicial y operadores del derecho. Se tiene como objetivo proponer una solución a fin de evitar conflictos entre las rondas campesinas reconocidas por la ley y la constitución y el ¨Poder Judicial, organismo estatal encargado de la administración de justicia ordinaria. A lo largo de la investigación se ha establecido que el conflicto de competencias se genera por cuanto no existe una legislación que delimite la competencia de las rondas campesinas. Si bien el Poder Judicial se encuentra seriamente cuestionado por la poca celeridad procesal, así como por la poca transparencia en la administración de justicia, es cierto también que las rondas campesinas en su afán de administrar justicia en el ámbito de su jurisdicción crean malestar a los jueces quienes intentan desconocer el derecho consuetudinario y los usos y costumbres de las rondas campesinas. A mayor abundamiento, las rondas resuelven conflictos en diferentes aspectos, civil, penal, de familia, etc. En muchos casos se exceden y generan problemas con los mismos miembros de su comunidad, resultando en frecuentes casos denunciados por secuestro, coacción, usurpación de funciones, etc. En este contexto, la presente investigación describe y explica el proceso formativo, los mecanismos y procedimientos utilizados en la resolución de conflictos, las actividades de desarrollo rural promovidos por las rondas campesinas de Chota, en el marco del respeto a los derechos humanos y desarrollo organizacional; acciones que en muchos casos generan controversia por cuanto no se garantiza la integridad de la persona investigada, En las indagaciones dentro de la organización rondera no se respeta un debido proceso, los procedimientos e indagaciones son acordes a sus usos y costumbres, es más, la carta magna garantiza el debido proceso, la presunción de inocencia, el principio indubio pro reo y la defensa del imputado, derechos que no son respetados dentro de la organización rondera. Con el sano propósito de llenar vacíos legales y comprometer una estrecha relación entre rondas campesinas y el Poder Judicial, se recomienda una norma que delimite la competencia tanto territorial como competencia de materia para las rondas campesinas, al mismo tiempo se sugiere un programa de educación en derechos humanos y desarrollo organizacional para mejorar el desempeño ronderil en la resolución de conflictos, con respeto a un debido proceso, a fin de evitar procesos penales contra los ronderos. Conociendo la eficiencia en la administración de justicia de las rondas campesinas, en ámbito de su jurisdicción se recomienda a la vez, la modificación del código procesal penal en lo referente a la investigación preliminar, en cuyo estadío de indagación deben participar los ronderos y, al ser así deben ser considerados como medios probatorios válidos las actas y esclarecimientos que se hace en las comunidades campesinas.
