Artículo 122-B en las denuncias por agresiones contra la mujer en el distrito judicial de Ica, año 2022

Debo sincerarme en el extremo de que ha sido para mí un gusto haber desarrollado un tema de palpitante actualidad y lo que a diario vemos en los pasillos del Poder Judicial del distrito judicial de nuestra provincia de Ica; es decir sus alcances del tipo penal sufridas por las mujeres producto de maltratos por violencia doméstica, la misma que se encuentra estatuida en el artículo 122-B del Código Penal. Tenemos que esclarecer que dicha normativa si bien es cierto que no satisface a una circunstancia agravante de la comisión del delito de lesiones leves, también es cierto que se trata de un tipo penal que goza de total autonomía, en vista que en lo que corresponde a las lesiones en su agravio. Por lo que estamos en condiciones de advertir que en este extremo los sujetos activos pueden ser cualquier persona. Para que se con figure esta figura delictiva es necesario que tenga la sola condición para que se cristalice es la aparición como causante de ello sea un hombre o varón. Por otro lado, podemos señalar que se puede considerar que la normativa de que estamos hablando es como si fuera una normativa en blanco. A nuestro entender podemos incidir que el referido artículo no está debidamente aclarado ni establecido por los juristas, ni mucho menos es aplicado en las sentencias o resoluciones judiciales emitidos por nuestros jueces penales. Además, existe ya una normativa que en extenso nos habla de los derechos y la forma de establecer penas y sanciones que los sujetos activos que violenten la normal vida de las mujeres o cualquier integrante del núcleo familiar, me refiero a la Ley 30364. ----- I must be honest to the extreme that it has been a pleasure for me to have developed a throbbing topic and what we see daily in the corridors of the judicial branch of the judicial district of our province; that is to say, its scope of the criminal type suffered by women as a result of mistreatment due to domestic violence, the same that is found in article 122-B of the Penal Code. We have to clarify that said regulation, although it is true that it does not satisfy an aggravating circumstance of the commission of the crime of minor injuries, it is also true that it is a criminal type that enjoys total autonomy, given that in what corresponds to injuries to your grievance. So we are in a position to notice that in this extreme the active subjects can be anyone. For this criminal figure to be configured, it is necessary that it have the only condition for it to crystallize is the appearance as the cause of it, whether it is a man or a man. On the other hand, we can point out that the regulation we are talking about can be considered as if it were a blank regulation. In our opinion, we can stress that the aforementioned article is not duly clarified or established by jurists, much less is it applied in the sentences or judicial resolutions issued by our criminal judges. In addition, there is already a regulation that tells us extensively about the rights and the way to establish penalties and sanctions that active subjects who violate the normal life of women or any member of the family nucleus, I am referring to Law 30364.
