The First Provincial Criminal Corporative Prosecutor's Office of Lambayeque requested the initiation of immediate proceedings and the subsequent accusation against the persons of Segundo Florencio Reyes Díaz, Iván Jair Núñez Guevara and Luis Miguel Cruz Díaz as co-authors of the crime of aggravated robbery, to the detriment of Joselin Gigliola Chozo Chiroque. The Supraprovincial Transitory Collegiate Criminal Court of Chiclayo and Ferreñafe FAILED; CONDEMNING the three defendants as co-perpetrators of the crime against property - attempted aggravated robbery, to the detriment of Joselin Gigliola Chozo Chiroque, with a custodial sentence of 09 years, setting as civil compensation the sum of S/. 500.00 to be paid jointly by those sentenced in favor of the aggrieved party. The three convicted filed an appeal. The Second Criminal Court of Appeals of Lambayeque. RESOLVES: 1) TO REVOKE the Judgment of First Instance in the extreme of the typicity of the facts, and; 2) REFORMING IT by redirecting the facts for the crime of attempted aggravated robbery, varying the sentence to 02 years and 06 months for the sentenced Luis Miguel Cruz Díaz, and another 02-year sentence suspended in its execution for the trial period of two years under rules of conduct for the sentenced Segundo Florencio Reyes Díaz and Iván Jair Núñez Guevara. The Public Ministry files an Appeal for Cassation. The Permanent Criminal Chamber of the Supreme Court of the Republic DECLARED FUNDED the appeal filed by the representative of the Public Ministry against the Second Instance Judgment, confirming the First Instance judgment that convicted Luis Miguel Cruz Díaz, Iván Jair Núñez Guevara and Segundo Florencio Reyes Díaz as co-perpetrators of the crime against property -Attempted Aggravated Robbery, to the detriment of Joselin Gigliola Chozo Chiroque. ORDERING the capture of those sentenced.
