Descripción
Sumario:The Comptroller General of the Republic of Peru, as established in Article 82 of the Political Constitution of Peru, is the highest body of the National Control System, in charge of supervising the legality of the execution of the State Budget, operations of the public debt and of the acts of the institutions subject to control; that is, they have the main function of verifying the correct application of public policies and the use of State resources and assets. For this reason, the correct application of the constitutional principles in the disciplinary administrative procedures that it establishes is essential, since the procedure to sanction offenders for functional administrative responsibility is made up of two instances under the General Comptroller's Office, which is the Instructing Body and the Sanctioning Body, having to guarantee total suitability and transparency in said procedures. The objective was to determine which are the constitutional principles that are violated by the Comptroller General of the Republic in its disciplinary administrative procedures in Peru. Therefore, the exploratory level basic research method oriented to the search for new knowledge was applied; In this way, the principle of human dignity, due process, reasonableness and proportionality and impartiality was achieved as a result.
