Departamento Académico de Industrias ForestalesEl objetivo principal de esta monografía es analizar el estado y las tendencias de la tala ilegal en las tres regiones de mayor producción de madera -Loreto, Madre de Dios y Ucayali- entre los años 2015 y 2019. La metodología incluye entrevistas semiestructuradas con expertos del sector, así como la revisión de la normativa vigente y de fuentes secundarias provenientes de instituciones gubernamentales y no gubernamentales, publicaciones académicas y recursos varios. De los resultados encontrados para el estado y las tendencias de la tala ilegal, se obtuvo que el riesgo de ilegalidad está disminuyendo en Predios Privados, Comunidades Nativas, Concesiones Forestales Maderables y Bosques Locales en la zona de estudio; lo cual se podría explicar por el aumento de las fiscalizaciones a Títulos Habilitantes, aunado a la contracción de los mercados internacionales. En relación a la normativa dirigida a la regulación de la trazabilidad de los recursos forestales, se observó que estaría dirigida principalmente hacia el control estricto de las operaciones, dejando de lado los beneficios que implica contar con un adecuado sistema de trazabilidad. De hecho, mayoría de los entrevistados identificó el enfoque punitivo y control excesivo como uno de los aspectos puntuales de la normativa forestal que interfieren con la promoción de la legalidad. Asimismo, casi dos tercios de los especialistas consideró la promoción de las compras responsables de madera de origen legal como una sugerencia hacia el ente normativo. En consecuencia, las recomendaciones se orientan hacia una normativa forestal más promotora y menos punitiva; donde el control se realice estratégicamente en campo e incluya a los funcionarios de las autoridades regionales. Otra recomendación destacada, corresponde a la elaboración de “Fichas de Homologación” de los productos de mayor demanda en el sector público, empleando este solvente mercado como motor de legalidad en el país.The main objective of this monograph is to analyze the state and trends of illegal logging in the three regions with the highest wood production - Loreto, Madre de Dios and Ucayali - between 2015 and 2019. The methodology includes semi-structured interviews with experts from the sector, as well as the review of current regulations and secondary sources from governmental and non-governmental institutions, academic publications and various resources. From the results found for the state and trends of illegal logging, it was obtained that the risk of illegality is decreasing in Private Property, Native Communities, Timber Forest Concessions and Local Forests in the study area; which could be explained by the increase in inspections of Qualifying Titles, combined with the contraction of international markets. In relation to the regulations aimed at regulating the traceability of forest resources, it was observed that it would be directed mainly towards the strict control of operations, leaving aside the benefits of having an adequate traceability system. In fact, the majority of those interviewed identified the punitive approach and excessive control as one of the specific aspects of forestry regulations that interfere with the promotion of legality. Likewise, almost two-thirds of the specialists considered the promotion of responsible purchases of wood of legal origin as a suggestion to the regulatory body. Consequently, the recommendations are oriented towards more promoting and less punitive forest regulations; where control is carried out strategically in the field and includes officials from regional authorities. Another notable recommendation corresponds to the preparation of “Approval Sheets” for the products in greatest demand in the public sector, using this solvent market as a driver of legality in the country.
