description La investigación fue un estudio de caso basado en parámetros de calidad a nivel exploratorio descriptivo y diseño transversal, donde el objetivo fue ¿Cuáles son las características del proceso sobre infracción a la ley penal: expediente N°01730-2017-0- 0801-JRFP-02; Segundo Juzgado Especializado de Familia, Cañete, Distrito Judicial de Cañete, Perú, 2019?, el objetivo general fue Determinar las características del proceso judicial sobre infracción a la ley penal; en el expediente N° 01730-2017-0-0801-jr-fp-02; segundo juzgado especializado en familia, cañete, distrito judicial de cañete, Perú 2019, la metodología de investigación fue de tipo cualitativo, siendo el nivel de investigación explorativo, descriptivo, la unidad de análisis fue un expediente seleccionado del archivo general, los datos de recolectaron utilizando la lista de cotejo, aplicando las técnicas de observación y análisis del contenido. Los resultados en primera instancia revelaron la sanción de internamiento con el pago de la reparación civil, y respecto a la segunda instancia confirma en todos sus extremos lo dispuesto en primera instancia. Se concluyó de este modo que respecto a ambas sentencias se comprueba el cumplimiento del proceso de manera legal correcta en cuento a la sanción del debido proceso.
