description La investigación expone que la penalización del aborto en casos de violación sexual, tal como señala la legislación peruana, existe una colisión de derechos, el de la vida del concebido con los derechos de igualdad, dignidad, libre desarrollo de su personalidad y la integridad física, en tanto, no protege los derechos fundamentales de la mujer esto de acuerdo con los tratados internacionales, así mismo, se destaca en la investigación la falta de medidas adecuadas por parte del Estado para abordar esta problemática, ya que no existe una norma que garantice la seguridad de las mujeres que deseen interrumpir un embarazo producto de un agresión sexual, vulnerando de este modo sus derechos fundamentales. Del mismo modo, la investigación revela que las mujeres que son víctimas de violación sexual en Perú confrontan diversas barreras sociales que afectan negativamente sus derechos, causando daños en su salud física, mental y psicosocial.
