description La presente investigación refirió como objetivo Identificar en qué condiciones se viene ejecutando el matrimonio notarial en la ciudad de Chota, región Cajamarca, año 2023. Por ello, contó con un enfoque cualitativo, básico y con un diseño de teoría fundamentada aplicando una entrevista a 5 participantes dentro de ellos 2 notarios y 3 abogados especialistas en materia civil, familiar y notarial. Se obtuvo como resultados que en la actualidad se encuentra vigente la Ley 31643 que norma la celebración del matrimonio en sede notarial, que el notario puede realizar matrimonios respetando su jurisdicción, además se pudo corroborar que existen restricciones para poder contraer matrimonio, así como también existen requisitos para el casamiento y por último se evidencio que los archivos del matrimonio son apostillados en el registro civil. Finalmente, se concluyó que el notario es un funcionario público que está autorizado legalmente para celebrar matrimonios y su participación en este acto es indelegable.
